Bricolage AI Beta Test Terms and Conditions

Welcome to the Bricolage AI Beta Test! These Terms and Conditions ("Terms") govern your participation in the beta test. By accessing or using Bricolage AI (the "Service"), you agree to be bound by these Terms.

1. Purpose of the Beta Test

The purpose of this beta test is to gather feedback on the Service's performance, functionality, and user experience. The Service is provided "as is" and may contain bugs, errors, and other issues. Your feedback is crucial for improving the Service.

2. Acknowledgment of Beta Risks

You acknowledge that the Service is a beta product and may be unstable, incomplete, and subject to change. The Service may contain bugs, errors, or other defects that could cause data loss, system failure, or other issues. Your use of the Service is at your own risk, and you agree that we are not liable for any such issues.

3. Eligibility and Participation

To participate in the beta test, you must be at least 18 years old. You agree to use the Service solely for its intended purpose and to provide honest and constructive feedback. We reserve the right to terminate your participation at any time, for any reason.

4. Account and Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

5. External API Connections

The Service allows you to connect your own APIs. You acknowledge and agree that you are solely responsible for the APIs you connect and the data that flows through them. We are not liable for any issues, data breaches, or damages that result from your connected APIs. You must comply with the terms and conditions of any third-party APIs you connect.

6. Indemnification

You agree to indemnify, defend, and hold harmless Bricolage AI, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, or expenses, including reasonable attorneys' fees and costs, arising out of or in any way connected with your access to or use of the Service, your connected APIs, or your violation of these Terms.

7. Data Privacy

We may collect, use, and store data related to your use of the Service for the purpose of improving the beta product. This includes usage data, crash reports, and any feedback you provide. We will handle your data in accordance with our Privacy Policy and applicable Canadian privacy laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA). You are responsible for ensuring that any data you connect via external APIs complies with these laws.

8. Intellectual Property

The Service and all intellectual property rights associated with it are owned by us. You are granted a limited, non-exclusive, non-transferable license to use the Service for the duration of the beta test. Any feedback, suggestions, or ideas you provide to us regarding the Service ("Feedback") will be considered non-confidential and non-proprietary. You hereby grant Bricolage AI a perpetual, irrevocable, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, modify, distribute, and create derivative works from your Feedback for any purpose without any obligation or compensation to you.

9. Confidentiality

All information related to the Service, including its features, performance, and your participation in the beta test, is confidential. You agree not to disclose this information to any third party without our prior written consent.

10. Disclaimers and Limitation of Liability

The Service is provided "as is" without any warranties, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure. We will not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of the Service.

11. Termination

These Terms will remain in effect for the duration of the beta test. We reserve the right to terminate your access to the Service at any time.

12. AI output disclaimer

Bricolage AI uses large language models to generate text, code, images, and other content. Outputs can be inaccurate, incomplete, biased, or fabricated (a behaviour commonly called "hallucination"). You are responsible for reviewing outputs before using them.

Do not rely on Bricolage outputs alone for legal, medical, financial, or safety-critical decisions. A qualified professional must review any output that materially affects a person's legal rights, employment, credit, housing, healthcare, insurance, or physical safety. Where required by law (including the EU AI Act and California SB-1001), you must disclose to your end users when they are interacting with an AI system.

13. Subscriptions, billing, refunds and cancellation

Paid plans are billed monthly in advance and renew automatically at the start of each billing cycle until you cancel. Token usage is passed through to you with a flat 5% platform overhead (lower on Enterprise and Innovator contracts) and billed in arrears against the same payment method.

You may cancel at any time from the billing portal. Cancellation is effective at the end of the current billing cycle. We do not refund partial billing periods. Token-usage charges that have already been incurred remain payable.

We do not refund subscription fees for accounts terminated for violations of the Acceptable Use Policy. Data export remains available for thirty days after termination unless legal process requires otherwise.

14. Intellectual property and copyright complaints

You retain ownership of the content you upload to Bricolage and of the artifacts your agents produce. You grant us a limited, non-exclusive licence to process that content as needed to operate the Service.

We respect intellectual property rights. If you believe content hosted on or generated through Bricolage infringes your copyright, send a written notice including: (a) your physical or electronic signature; (b) identification of the work claimed to be infringed; (c) identification of the material to be removed and information sufficient to locate it; (d) your contact information; (e) a statement that you have a good-faith belief the use is not authorized; and (f) a statement under penalty of perjury that the information is accurate and that you are authorized to act. 15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein.
